National guard troops from Texas are heading to Illinois after a federal judge declined to immediately block them after a lawsuit from the state against the Trump administration.

Texas guard members departed the Fort Bliss military installation in El Paso on a US military transport plane on Monday evening.

The US district judge April Perry allowed the federal government to continue the deployment in Chicago while it responds to Illinois’s suit. She set a deadline of midnight on Wednesday for the government to reply. A similar effort to deploy troops to Portland was blocked by a judge in Oregon.

Donald Trump is also seeking to federalize the Illinois national guard, which would involve moving them from state to federal jurisdiction.

    I read about this a little because I was wondering why there was a decline/delay to block. Apparently Ms Perry is trying to ascertain if the guard is actually being mobilized at all. The government is being uncooperative and not answering her questions so it’s unclear if this is actually happening or not. If it does, and the government hasn’t/doesn’t respond to her then it should be a very easy ruling to make. Even still, it seems she also agrees that sending them, in general, is stupid and unnecessary.

    I think she doesn’t want to prematurely make a ruling until we have confirmation either because they just show up or the government actually answers her.

      If she blocks them from going and they weren’t going, what was the harm?

      Seems like a stupid detail to delay a decision on. The whole point of injunctions is to prevent the bad shit from happening. If it wasn’t going to happen anyway, it’s not like the words were such a valuable resources that got wasted making sure

        It’s because some people are still playing by a rulebook that’s burning in the corner trash can. Some people are still concerned with “what’s proper”.

        In other words, “because she’s living in a fantasy world where normally that would have been a bad look”
