In Louisiana, the penalty for the creation or possession of a deepfake of a minor is imprisonment for 5 to 20 years, and a fine up to $10,000. Mandatory minimum is at least 5 years. And they must be served without parole, probation, or suspension of sentence.
Seems that Louisiana already considers this an act of violence, and treats it accordingly. The school should be in deep shit here, and the police say that there is a kid being charged with 10 counts of distributing AI generated nude images. I very much doubt he’ll be tried as an adult, but I dont see him just walking away from this.
The school though? They had a report of AI generated child abuse images being distributed, and they didnt immediately report it. That isnt just wrong, thats illegal as Louisiana has mandatory reporting laws, and doesnt make a distinction between real and deepfake child abuse images. The school had not only a moral duty, but a legal duty to act. And it didnt. That school, is fucked. The family can sue for millions, and whichever teachers failed to act, could be on their way to jail and will find themselves personally liable for their failure to act as well.
