    That’s why in some country, like all members of the European Union for example, patent on seeds are unrecognized by the law. You can still patent it, paradoxically, but if you go to court to defend your patent, you’ll loose. Same with software, theoretically. (In practice, few judge understand the difference between hardware (whish is patentable) and software, so you might still win if you defend a brevet on software. That said, software is still protected under our equivalent to copyrights, so a brevet on top of that is overkill anyway.)
