Handing over migrants to the so-called Libyan coastguard is a crime. This has been established by the Court of Naples, which sentenced the commander of the ship Asso28 to one year imprisonment because after having rescued 101 migrants, including several minors and pregnant women, he agreed to hand them over to Tripoli. (…) At the judges’ disposal, in addition to the investigations carried out by the Naples Harbour Master’s Office, there were also audio recordings of radio conversations heard on 30 July 2018 by the “Open Arms” ship. (…) The grounds for the judgment, which will be filed within three months, will clarify what convinced the court to find the captain guilty of having abandoned the migrants he had rescued to the authorities of a country that the United Nations does not recognise as a “safe place of disembarkation”. Both the captain and the representative of the shipping company were acquitted of the charge of abuse of office.
